Agreement to Terms By accessing or using the website, booking services, or vehicle rental services of Hector's Whips, LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with these terms, do not use our services. 2. Rental Agreement The rental of any vehicle from Hector's Whips is subject to a separate Rental Agreement provided and signed before vehicle pickup. These Terms of Service supplement but do not replace the Rental Agreement. Where these Terms and the Rental Agreement conflict, the Rental Agreement controls for matters relating to your rental. 3. Eligibility and Driver Requirements To rent a vehicle you must provide a valid driver's license, proof of insurance, and any additional documentation we request. Driver requirements, including minimum age, are specified in our Rental Policies and the Rental Agreement. We reserve the right to decline any reservation at our sole discretion, including for past violations of our policies. 4. Reservations and Accurate Information You agree to provide accurate and complete information when making a reservation, including your legal name, contact information, and payment details. Reservations are subject to vehicle availability. We may cancel or refuse any reservation made with inaccurate, incomplete, or fraudulent information. 5. Identity and Document Verification Before pickup, we require you to upload your driver's license and proof of insurance, and to sign our rental policies electronically. We use automated tools, including AI-assisted document analysis, to help verify the documents you submit. Final verification decisions are made by our staff. Reservations cannot be released for pickup until verification is complete. 6. Payment Terms We accept major credit cards only (Visa, Mastercard, American Express, Discover). Debit cards and prepaid cards are not accepted for vehicle reservations. When you book, we place a pre-authorization hold on your credit card covering your rental total plus a security deposit as displayed at checkout. This is a hold, not a charge; the final amount is captured when you return the vehicle, and the remainder of the hold is released. Pre-authorization holds may be renewed while your rental is active. Additional charges (fuel, damage, late return, tolls, citations) may apply per the Rental Agreement. 7. Cancellations and Changes You may request changes to your reservation through our customer portal or by contacting us. Cancellation and refund terms are described in our Rental Policies and Rental Agreement. 8. Vehicle Use You agree to use rented vehicles in accordance with all applicable laws and the Rental Agreement, return vehicles in the condition received (normal wear excepted), and report any accident, damage, or mechanical issue immediately. 9. GPS and Vehicle Telematics Our vehicles are equipped with GPS tracking and telematics devices that report location, movement, and vehicle-health data while the vehicle is in our fleet, including during your rental. We use this data for fleet management, maintenance, safety, theft prevention and recovery, and to enforce the Rental Agreement. By renting a vehicle you consent to this tracking for the duration of your rental. 10. Communications, Calls, and Text Messages We communicate about your reservation by email and, if you opt in, by SMS text message. Text messages are transactional (booking confirmations, pickup and return reminders, vehicle status, and replies from our staff). Message frequency varies by rental. Message and data rates may apply. Reply STOP at any time to stop receiving texts and HELP for help. Consent to receive text messages is not a condition of renting from us. Telephone calls to and from our office may be recorded for quality and training purposes, and our facilities may use video surveillance. 11. Insurance and Liability Hector's Whips maintains insurance on its vehicles. Renters may be responsible for deductibles and for damages resulting from policy violations, prohibited use, or negligence, as detailed in the Rental Agreement. To the maximum extent permitted by law, our total liability arising out of your use of our services is limited to the amounts you paid us for the rental at issue. 12. Prohibited Conduct We may refuse service, cancel reservations, or terminate a rental for fraud, misrepresentation, non-payment, unsafe or unlawful vehicle use, or violation of these Terms or the Rental Agreement. 13. Website and Intellectual Property All content on this website, including text, images, logos, and software, is the property of Hector's Whips, LLC or its licensors and may not be copied or used without permission. You agree not to interfere with the operation or security of the website. 14. Disclaimers Our website and booking services are provided "as is" without warranties of any kind, express or implied. We do not warrant that the website will be uninterrupted or error-free. 15. Governing Law These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be brought in the state or federal courts located in Spokane County, Washington. 16. Modifications We may modify these Terms at any time by posting an updated version on this page with a revised "Last Updated" date.
